Terms and Conditions of Use

These Terms and Conditions ("Terms") govern your access to and use of the Wanderer platform, available at www.wanderer.live and via any associated mobile application (the "Platform"). By creating an account or otherwise using the Platform, you agree to be bound by these Terms.

1. Nature of the Platform

1.1 Platform Description

Wanderer is an online directory and discovery service that connects independent event organisers ("Hosts") with individuals seeking spiritual, cultural, and human experiences ("Participants" or "Users"). Wanderer operates as a passive hosting intermediary and information-society service provider within the meaning of Article 6 of Regulation (EU) 2022/2065 (the Digital Services Act). Wanderer does not organise, co-organise, promote, or conduct any event listed on the Platform.

1.2 Absolute Limitations on Wanderer's Role — Expression of Interest Only, Never a Booking

WANDERER DOES NOT MANAGE, PROCESS, FACILITATE, INTERMEDIATE, GUARANTEE, OR OTHERWISE PARTICIPATE IN BOOKINGS, RESERVATIONS, TICKETING, ATTENDANCE CONFIRMATIONS, OR PAYMENT TRANSACTIONS OF ANY KIND.

The Platform's sole function in connection with any listed event is to allow a Participant to express non-binding interest in attending ("Expression of Interest"). When a Participant expresses interest, the Platform shares a limited set of contact details with the Host — full name, email address, and any social or messaging handles the Participant has chosen to add to their profile (WhatsApp, Telegram, Instagram, Facebook, or X) — solely so the Host and the Participant can communicate directly and arrange attendance between themselves, off-platform.

  • An Expression of Interest is not a registration, reservation, ticket purchase, or booking of any kind.
  • An Expression of Interest does not create any contract between the Participant and Wanderer (the Platform operator), and does not obligate the Host to accept, confirm, or admit the Participant to the event.
  • Any confirmation of attendance, capacity management, waiting list, check-in, or admission decision is handled exclusively and directly between the Host and the Participant, entirely outside the Platform.
  • Any indicator displayed on the Platform (such as a count of interested Participants) is informational only and must never be read as a guarantee of a place at the event.

1.3 No Guarantee of Participation or Event

Wanderer does not guarantee that a listed event will actually take place, that it will take place on the date, at the time, or at the location stated, that the Host will respond to an Expression of Interest, or that the Participant will be admitted to attend. Wanderer does not verify the identity, qualifications, credentials, certifications, insurance, or reliability of Hosts, and does not inspect event venues. Wanderer is not a party to, and accepts no responsibility for, any arrangement, agreement, or transaction that a Host and a Participant may subsequently reach between themselves as a result of an Expression of Interest.

2. Eligibility and Account Registration

2.1 Age Requirement

Use of the Platform is reserved exclusively for persons who are at least 18 years of age. Upon registration you expressly declare that you are at least 18 years old; this declaration is recorded together with the date and time of acceptance. We reserve the right to suspend or terminate without notice any account for which we have reason to believe this requirement is not met, and we invite anyone who becomes aware of an account belonging to a minor to report it to us at support@wanderer.live.

2.2 Account Registration

You may register using email/password or supported social sign-in methods (e.g. Google). The following information is required to create an account:

2.4 Account Security Obligations

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@wanderer.live of any unauthorised use.

3. Legal Compliance, Substances, and Risks

3.1 Host Legal Compliance Obligations

Hosts are solely responsible for ensuring that their events, and every activity conducted within them, comply with all applicable laws in the jurisdiction where the event takes place.

3.2 Absolute Ban on Events Involving Illegal Substances

IT IS PROHIBITED TO LIST ON THE PLATFORM ANY EVENT THAT INVOLVES, INCLUDES, OFFERS, DISTRIBUTES, OR IN ANY WAY FACILITATES THE USE OF NARCOTIC OR PSYCHOTROPIC SUBSTANCES THAT ARE ILLEGAL IN THE JURISDICTION WHERE THE EVENT TAKES PLACE. ANY SUCH LISTING WILL BE REMOVED AND THE HOST'S ACCOUNT PERMANENTLY TERMINATED.

  • The ban applies regardless of whether the substance is described as ceremonial, sacramental, therapeutic, traditional, or a 'plant medicine'.
  • The ban also applies to listings framed in allusive, coded, or externally redirected language where the illegal substance is nonetheless identifiable.
  • You may not use the Platform to recruit participants, collect contact details, or direct people towards activities that would be prohibited if listed directly.
  • We reserve the right to remove without notice any listing that, in our reasonable judgement, violates this ban, and to report the violation to the competent authorities where required by law.

Wanderer does not have the means to proactively verify the actual content of each event and does not carry out general monitoring of listings, in accordance with Article 8 of Regulation (EU) 2022/2065. Compliance with this ban rests on the Host's declaration and on community reports (Section 9). Hosts and Participants remain solely and exclusively responsible for the lawfulness of their own conduct.

3.3 No Medical or Therapeutic Purpose

NO CONTENT ON THE PLATFORM CONSTITUTES MEDICAL, PSYCHOLOGICAL, PSYCHIATRIC, THERAPEUTIC, OR NUTRITIONAL ADVICE. WANDERER DOES NOT PROVIDE HEALTHCARE SERVICES AND DOES NOT GUARANTEE ANY OUTCOME.

Hosts may not present their events as medical treatments, diagnoses, cures, or substitutes for a healthcare pathway, nor may they guarantee therapeutic results. Persons with relevant physical or mental health conditions, who are pregnant, or who are taking medication are encouraged to consult a qualified healthcare professional before attending any event.

3.4 Assumption of Risk by the Participant

Each Participant independently decides, entirely at their own risk, whether to contact a Host and whether to attend an event after doing so. You expressly acknowledge and accept that events listed on the Platform may involve physically demanding activities, emotionally intense experiences, altered states of consciousness, stays in remote locations, or encounters with strangers, and that such activities carry inherent risks — including risk of physical injury, psychological distress, or financial loss — which you assume in full.

Wanderer strongly recommends that you exercise your own judgement, ask Hosts questions directly, verify their qualifications, inform a trusted person of your attendance, and assess any information relevant to your safety and legal exposure before attending. To the extent permitted by law, you waive any claim against Wanderer arising from events occurring during or in connection with an event, without prejudice to Section 12.4.

4. Host Terms

4.1 Host Representations and Warranties

By listing an event, the Host represents and warrants that the listing is accurate and not misleading, that they hold every permit, licence, authorisation, or qualification required by law, that they have a suitable right to use the venue, and that they will conduct the event safely and lawfully.

4.2 Insurance

Wanderer strongly recommends that every Host obtain adequate public liability insurance for their activities, and considers this necessary for events involving physical risk. We reserve the right to request proof of such coverage from the Host and to suspend listings in the absence of a response. Wanderer does not provide, intermediate, or guarantee any insurance coverage for Hosts or Participants.

4.3 Event Location Data

Hosts must provide, at minimum, the city where the event takes place. Hosts may freely choose whether to publish the exact venue address or to share it only after direct contact with an interested Participant.

4.4 Payments, Pricing, and Absence of Payment Intermediation

WANDERER DOES NOT PROCESS, COLLECT, HOLD, OR INTERMEDIATE ANY PAYMENT BETWEEN A HOST AND A PARTICIPANT. THE PLATFORM CONTAINS NO PAYMENT OR CHECKOUT FUNCTIONALITY OF ANY KIND.

Any price, donation amount, or payment arrangement stated in a listing is informational only and is settled exclusively and directly between Host and Participant, off-platform, by whatever method they agree upon (cash, bank transfer, or any other means of their choice). Wanderer does not set prices, does not verify that they are honoured, does not issue tax documents on behalf of the Host, and does not manage refunds.

4.5 Prohibited Event Listings

You may not list events that:

  • Are illegal in the jurisdiction where they take place, or that involve illegal substances under Section 3.2.
  • Involve non-consensual physical or psychological harm, or coercive practices.
  • Are presented as medical treatments or promise therapeutic outcomes, in violation of Section 3.3.
  • Are directed at minors under 18 or allow their participation.
  • Promote hateful, discriminatory, or supremacist ideologies, or constitute recruitment into undisclosed organisations.
  • Contain explicit sexual content, or are aimed at prostitution or sexual exploitation.
  • Otherwise violate the Community Standards.

4.6 Host as Independent Data Controller

When a Participant expresses interest in an event, the Host receives the relevant contact details and becomes, in respect of those details, an independent data controller under Regulation (EU) 2016/679 (GDPR). The Host accordingly undertakes to:

  • Process those details solely for purposes connected to the specific event for which they were shared.
  • Not use them for marketing, solicitation, or promotion of other events or services without the data subject's specific and demonstrable consent.
  • Not disclose them to third parties or transfer them outside the European Economic Area without an appropriate legal basis.
  • Adopt adequate security measures, in particular regarding data exported from the Platform in CSV or XLSX format.
  • Respond autonomously and without delay to requests to exercise data-subject rights (access, rectification, erasure, objection), including when such requests are forwarded via Wanderer.
  • Delete the data when no longer needed for the purpose of the event.

For contacts that the Host adds manually to their Circle area — including contacts of persons not registered on the Platform — the Host is the sole data controller and declares that they have an appropriate legal basis for their processing and for sending any communications. Wanderer acts in that case as data processor on behalf of the Host, limited to the technical storage and transmission of such data, in accordance with the documented instructions in this Section and in the Privacy Policy. The Host indemnifies and holds Wanderer harmless from any claim arising from non-compliance with the obligations in this Section.

5. Tax Obligations

5.1 Exclusive Fiscal Responsibility of Hosts

Hosts are solely responsible for determining, declaring, and paying any tax, VAT, or social-security contribution arising from amounts they receive in connection with their events.

5.2 Absolute Exclusion of Wanderer's Fiscal Liability

Because Wanderer never processes, collects, or has visibility over any payment made between Host and Participant, Wanderer bears no fiscal reporting or withholding obligation of any kind in respect of such payments.

5.3 Host Indemnification for Tax Claims

Hosts agree to indemnify and hold Wanderer harmless from any claim, penalty, or liability arising from a Host's failure to meet their own tax obligations.

6. Acceptable Use and Prohibited Conduct

  • Do not impersonate another person or misrepresent your affiliation with any person or entity.
  • Do not use the Platform to harass, threaten, defraud, or discriminate against any other user.
  • Do not scrape, mass-extract data, reverse-engineer, or interfere with the Platform's operation or security.
  • Do not use the Platform or data obtained from it to train artificial intelligence systems or to build competing databases.
  • Do not use contact details obtained via an Expression of Interest for any purpose other than the specific event to which the interest relates.
  • Do not post false, misleading, or illegal content of any kind.
  • Do not create multiple or fictitious accounts, in particular to gain advantages in the invite programme (Section 8).

7. Reviews and Feedback

REVIEW TRANSPARENCY: WANDERER DOES NOT VERIFY THAT THE AUTHOR OF A REVIEW ACTUALLY ATTENDED THE EVENT OR MET THE HOST. BECAUSE THE PLATFORM DOES NOT MANAGE BOOKINGS OR ATTENDANCE CONFIRMATIONS, WE HAVE NO DATA THAT WOULD ALLOW SUCH VERIFICATION.

Reviews published on the Platform reflect solely the opinion of their authors and do not constitute an assessment, endorsement, or recommendation by Wanderer. We do not order, filter, or weight reviews in exchange for any consideration, and we do not publish false or commissioned reviews.

  • Reviews must be honest, based on direct personal experience, and formulated respectfully.
  • It is prohibited to post false reviews, purchase them, exchange them, or orchestrate negative review campaigns.
  • A Host who considers a review false, defamatory, or contrary to the Community Standards may contest it by writing to support@wanderer.live; we will examine the report and may remove the review or allow the Host to reply.
  • We reserve the right to remove reviews that violate these Terms or the Community Standards, giving the author reasons for the removal.

8. Invite Programme

The Platform may offer a programme that allows you to invite others via a personal link and to accumulate points upon reaching certain milestones (for example, when an invited person registers). The programme is governed by the following conditions:

  • Points are purely symbolic and community-recognition in nature. They have no monetary value, do not constitute electronic money, credit, securities, or financial instruments.
  • Points cannot be converted into money, are non-refundable, non-transferable to third parties, and non-heritable.
  • Invites must be directed at people you genuinely know and may not take the form of unsolicited mass sending, spam, or automated posting.
  • Self-invites, multiple accounts, fictitious accounts, and any other practice aimed at artificially accumulating points are prohibited.
  • In the event of abuse we reserve the right to reset accumulated points, revoke any recognition, and suspend the account.
  • We may modify the point attribution criteria or discontinue the programme at any time, with reasonable advance notice; discontinuation of the programme does not give rise to any entitlement to compensation.

9. User Content, Reporting, and Moderation

9.1 Content Responsibility

All content published on the Platform — event listings, profile text, images, reviews — is user-generated, and users are solely responsible for it. Wanderer does not exercise prior editorial control and does not carry out general monitoring of content.

9.2 How to Report Illegal Content

Anyone may report content they consider illegal or contrary to these Terms using the report form available on event and profile pages, or by writing to safety@wanderer.live. To enable us to act, the report should identify the relevant content (link or title), the reason for the report, and a contact address for our response.

9.3 Handling of Reports

  • We acknowledge receipt of every report and examine it in a timely, diligent, non-arbitrary, and objective manner.
  • At the conclusion we inform the reporting party of the decision taken and the available means of redress.
  • Where we remove content or restrict an account, we inform the affected user of the reasons for the decision, unless prohibited by law.
  • A user who considers the decision erroneous may request review by writing to support@wanderer.live within 6 months. The review is carried out by a person different from the one who took the initial decision, where organisationally feasible.
  • We do not tolerate retaliation against anyone who reports in good faith. Manifestly unfounded and repeated reports may result in suspension of reporting access.

Wanderer is currently a micro-enterprise within the meaning of Commission Recommendation 2003/361/EC and accordingly benefits from the exemptions provided by Article 19 of Regulation (EU) 2022/2065. We nonetheless apply the procedures described above as a voluntary commitment to our community.

10. Intellectual Property Rights

The Platform, its design, code, and branding are the exclusive property of Wanderer or its licensors. Users retain ownership of content they upload but grant Wanderer a non-exclusive, royalty-free, worldwide, and revocable licence to display, reproduce, technically adapt, and translate that content on the Platform and in service-related communications, solely for the purposes of operating and promoting the service. This licence ceases upon removal of the content, save for backup copies and uses already initiated. By posting content, you warrant that you hold all necessary rights, including rights over images depicting persons.

11. Disclaimers of Warranties

The Platform is provided "as is" and "as available", without warranties of any kind, express or implied, including as to accuracy, reliability, continuity of service, or fitness for a particular purpose. Wanderer does not warrant that a Host will respond to, confirm, or honour an Expression of Interest, or that an event will take place as described. These disclaimers do not affect any non-excludable statutory warranties to which consumers are entitled.

12. Limitation of Liability

12.1 General Exclusion

To the fullest extent permitted by law, Wanderer is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, or from the conduct of Hosts, Participants, or third parties.

12.2 Financial Cap

Subject to Section 12.4, Wanderer's aggregate liability for any claim arising from these Terms is limited to the greater of (a) the fees paid to Wanderer in the twelve months preceding the claim, or (b) EUR 100.

12.3 Specific Exclusions

  • Payments — because Wanderer never handles payments between Host and Participant, we bear no liability whatsoever for any payment dispute, non-payment, refund disagreement, or financial loss arising between them.
  • Participation — Wanderer is not liable for a Host's failure to respond, for an event's failure to take place, for cancellation, for refusal of admission, or for any decision relating to attendance, as these matters are handled entirely outside the Platform.
  • Illegal events — Wanderer bears no liability for any regulatory, criminal, or civil consequence arising from an event that turns out to be unlawful or conducted in violation of these Terms.
  • Event safety — Wanderer is not liable for injury, damage, or loss sustained before, during, or after an event, the organisation and conduct of which are the exclusive responsibility of the Host.

12.4 Non-Excludable Liability

NOTHING IN THESE TERMS EXCLUDES OR LIMITS WANDERER'S LIABILITY FOR WILFUL MISCONDUCT OR GROSS NEGLIGENCE, FOR DEATH OR PERSONAL INJURY CAUSED BY OUR OWN CONDUCT, OR FOR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

13. Indemnification

You agree to indemnify and hold Wanderer harmless from any claim, damage, penalty, or expense (including reasonable legal costs) arising from your breach of these Terms, your use of the Platform, content you post, or your conduct during or in connection with an event. This clause does not apply to consumers to the extent prohibited by applicable law.

14. Privacy and Data Protection

The collection and use of personal data is governed by our Privacy Policy, incorporated into these Terms by reference. Note that once a Participant expresses interest in an event, the Host receives certain contact details directly and becomes an independent data controller in respect of any further processing of that data, subject to the conditions set out in Section 4.6.

15. Account Suspension and Termination

Wanderer may suspend or terminate any account that violates these Terms, the Community Standards, or applicable law. Except in cases of serious violations, legal obligations, or risk to user safety, we will notify the person concerned of the reasons for the decision and the possibility of requesting review under the procedure in Section 9.3.

You may terminate your account at any time from your profile settings or by writing to support@wanderer.live. Termination results in deletion of your data in accordance with the terms set out in the Privacy Policy. Event listings and received reviews are removed or anonymised. Termination does not affect arrangements already concluded directly between Host and Participant outside the Platform.

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms are governed by Italian law and applicable European Union law. Where you act as a consumer, this choice does not deprive you of the protection afforded by the mandatory provisions of the law of your country of habitual residence.

16.2 Jurisdiction

The parties will first attempt to resolve any dispute amicably by writing to support@wanderer.live. Failing that, disputes with users acting as consumers shall fall within the exclusive jurisdiction of the courts of the consumer's place of residence or elected domicile, pursuant to Article 66-bis of the Italian Consumer Code and Regulation (EU) 1215/2012. Disputes with users acting in the course of their professional activity shall fall within the exclusive jurisdiction of the courts of Milan, Italy.

16.3 Alternative Dispute Resolution

Consumers resident in the European Union may use the competent alternative dispute resolution (ADR) bodies. Use of such procedures is optional and does not prejudice the right to seek redress before the courts.

17. Amendments to These Terms

We may update these Terms from time to time. Material changes will be notified by email at least 14 days before they take effect. Continued use of the Platform after that date constitutes acceptance of the revised Terms; if you disagree you may terminate your account without cost before the changes take effect.

18. Miscellaneous Provisions

  • Severability — if any provision is held unenforceable, it shall be replaced by a valid provision of equivalent economic effect, and the remaining provisions shall remain in full force and effect.
  • Entire Agreement — these Terms, together with the Privacy Policy, Cookie Policy, and Community Standards, constitute the entire agreement between you and Wanderer.
  • No Waiver — our failure to enforce any right does not constitute a waiver of that right for the future.
  • Assignment — you may not assign these Terms without our consent; we may assign them on notice to you, in which case you may terminate your account.
  • Force Majeure — neither party is liable for delay or failure caused by events beyond its reasonable control.
  • Language — these Terms are available in Italian, English, Spanish, and Portuguese. Each language version is fully binding on users who use the Platform in that language. In the event of any interpretive divergence between versions, the Italian version prevails, unless that would deprive a consumer of the protection afforded by the version in the language in which the Terms were presented to them.
  • Survival — Sections 3, 4.6, 5, 10, 12, 13, and 16 survive termination of the account.
